Under the federal Fair Labor Standards Act (FLSA), most hourly employees must be paid at least 1.5 times their regular rate for every hour worked over 40 in a workweek. Enter your hourly rate and hours below to see your regular pay, overtime pay and total gross pay.

Some states add their own rules, such as daily overtime. If you work in California or Colorado, use the state calculators linked further down the page.

Federal overtime rules at a glance

  • Overtime starts after 40 hours in a workweek.
  • Overtime pay is at least 1.5× the regular rate of pay.
  • The workweek is a fixed period of 168 hours (seven 24-hour days in a row). It can start on any day.
  • Overtime is calculated per workweek, not per pay period.
  • Paid time off, such as vacation or sick leave, is not counted as hours worked for overtime.

How federal overtime pay is calculated

Add up the hours you worked in the workweek. The first 40 are paid at your regular hourly rate. Each hour after that is multiplied by 1.5.

Your regular rate can be higher than your base wage if you also receive non-discretionary pay such as production bonuses or shift differentials. This calculator uses the single hourly rate you enter.

Gross pay = (regular hours × rate) + (overtime hours × rate × 1.5)

Example: 48 hours at $20 an hour

You worked 48 hours in the workweek.

  1. Regular pay: 40 hours × $20.00 = $800.00
  2. Overtime pay: 8 hours × $30.00 = $240.00
  3. Gross pay: $1,040.00

Who is not eligible for overtime?

Some employees are exempt from overtime. Executive, administrative, professional, outside sales and certain computer employees can be exempt if they meet both a salary test and a job duties test. A job title or a salary alone does not make someone exempt.

Frequently asked questions

How is overtime pay calculated?

Multiply your regular hourly rate by 1.5 and then by the number of hours worked over 40 in the workweek. Add that to your regular pay for the first 40 hours.

Is overtime paid after 8 hours a day?

Not under federal law. Federal overtime is based on the workweek. Some states, including California and Colorado, add daily overtime rules.

Do paid holidays or vacation count toward overtime?

No. Under the FLSA, only hours actually worked count toward the 40-hour threshold. Paid leave does not.

Can I get compensatory time instead of overtime pay?

Private employers generally must pay overtime in cash. Government employers are allowed to offer compensatory time off in some cases.

Are salaried employees entitled to overtime?

Only if they do not qualify for an exemption. Salary level and job duties both matter.
