Florida has no state overtime law for private employers, so the federal Fair Labor Standards Act sets the rule: hours over 40 in a workweek are paid at 1.5 times the regular rate.

Florida does have its own minimum wage, set in the state constitution and higher than the federal minimum. That affects your regular rate, but not the overtime multiplier, which stays at 1.5×.

Florida overtime rules at a glance

  • Overtime starts after 40 hours in a workweek.
  • Overtime pay is 1.5× the regular rate.
  • No daily overtime, weekend premium or holiday premium is required by law.
  • The Florida minimum wage is separate from the federal one and sets the floor for your regular rate.
  • Unpaid overtime claims are typically made under federal law.

How Florida overtime pay is calculated

Add up all hours in the workweek. Hours up to 40 are paid at your regular rate. Each hour after 40 is paid at 1.5 times that rate.

Because there is no daily limit, a 12-hour day does not trigger overtime on its own. Only the total for the workweek matters.

Gross pay = (regular hours × rate) + (overtime hours × rate × 1.5)

Example: 50 hours at $18 an hour

You worked 50 hours in the workweek.

  1. Regular pay: 40 hours × $18.00 = $720.00
  2. Overtime pay: 10 hours × $27.00 = $270.00
  3. Gross pay: $990.00

Who is not eligible for overtime?

Exemptions come from the federal rules. Executive, administrative, professional and certain other employees can be exempt if they meet duties and salary tests. Hourly pay and job titles alone do not decide it.

Some industries common in Florida, such as agriculture and seasonal amusement or recreation businesses, have partial or full federal exemptions. Check the Department of Labor fact sheets for your industry.

Frequently asked questions

Does Florida have its own overtime law?

No. Florida does not have a state overtime statute for private employers, so overtime is governed by the federal FLSA.

How much is overtime in Florida?

One and a half times your regular rate for hours over 40 in a workweek. At $18 an hour, overtime is $27 an hour.

Does Florida require overtime for working over 8 hours a day?

No. Only the total for the workweek matters. A long day is not overtime unless it takes you past 40 hours for the week.

Where do I report unpaid overtime in Florida?

You can contact the U.S. Department of Labor Wage and Hour Division or speak with an employment attorney. Federal claims generally have a two-year time limit, or three years for willful violations.

Do salaried employees in Florida get overtime?

Only if they do not meet an exemption. Both salary level and job duties matter, and a salary alone does not make someone exempt.
