Colorado goes beyond the federal rule. Overtime at 1.5 times your regular rate is owed for hours over 40 in a workweek, hours over 12 in a workday, and hours over 12 consecutive hours, whichever gives the employee more overtime.

This calculator handles the daily 12-hour line and the weekly 40-hour line. It does not model the 12-consecutive-hour rule, which matters when a shift runs across midnight.

Colorado overtime rules at a glance

  • Over 40 hours in a workweek: 1.5× the regular rate.
  • Over 12 hours in a workday: 1.5× the regular rate.
  • Over 12 consecutive hours, even across two workdays: 1.5× the regular rate.
  • The calculation that gives the employee more overtime hours is the one that applies.
  • There is no daily double-time requirement under the standard rule.

How Colorado overtime pay is calculated

For each day, the first 12 hours are regular and anything beyond that is overtime. Then the calculator adds up the regular hours, and if they exceed 40 for the week, the excess is also overtime.

Each hour is counted once. The result equals the larger of the daily overtime total and the weekly overtime total, which is how the Colorado rule is applied.

Gross pay = (regular hours × rate) + (overtime hours × rate × 1.5)

Example: Three 14-hour shifts at $24 an hour

You work three days of 14 hours each, for 42 hours in total.

  1. Each day: 12 regular hours and 2 overtime hours
  2. Week total: 36 regular hours and 6 overtime hours (still under 40 regular)
  3. Regular pay: 36 × $24.00 = $864.00
  4. Overtime pay: 6 × $36.00 = $216.00
  5. Gross pay: $1,080.00

Under the federal weekly rule alone, the same week would be 40 regular and 2 overtime hours, or $1,032.00.

Who is not eligible for overtime?

Exemptions under Colorado wage rules depend on job duties and salary, and the salary thresholds follow a state formula that changes over time. Confirm current numbers with the Colorado Department of Labor and Employment.

Colorado's wage rules are published in the Colorado Overtime and Minimum Pay Standards (COMPS) Order. Some occupations and employers are covered by different provisions.

Frequently asked questions

Does Colorado have daily overtime?

Yes. Hours over 12 in a workday are overtime, as are hours over 12 consecutive hours. Weekly overtime after 40 hours also applies.

Is overtime in Colorado paid after 8 hours a day?

No. The daily threshold is 12 hours, not 8. A 10-hour day does not create overtime unless your total for the workweek goes above 40.

What is the overtime rate in Colorado?

One and a half times the regular rate of pay for all overtime hours.

What is the COMPS Order?

The Colorado Overtime and Minimum Pay Standards Order is the set of state rules covering overtime, minimum pay, rest breaks and meal periods for most employees.

Does this calculator handle shifts that cross midnight?

Not fully. It treats each day separately. If a single shift runs more than 12 hours across two calendar days, check the consecutive-hours rule with the Colorado Department of Labor and Employment.
