| Pay type | Hours | Rate | Pay |
|---|---|---|---|
| Regular | 40 | $20.00 | $800.00 |
| Overtime (1.5×) | 10 | $30.00 | $300.00 |
New York requires overtime at 1.5 times the regular rate for hours over 40 in a workweek, which matches the federal standard for most workers. The state also has its own rules about who counts as exempt, and in several cases they are stricter than the federal ones.
For hourly employees the math is the same as the federal calculation, so this tool counts the total hours in the week and does not apply a daily limit.
New York overtime rules at a glance
- Overtime starts after 40 hours in a workweek for most employees.
- Overtime pay is 1.5× the regular rate.
- Domestic workers have their own threshold. Live-in domestic workers are covered after 44 hours, so check with the Department of Labor.
- Exempt salary thresholds for executive and administrative employees are set by the state and differ by region.
- Separate pay rules, such as spread-of-hours pay, are not overtime and are not included here.
How New York overtime pay is calculated
Add up all hours worked in the workweek. The first 40 hours are regular. Each hour beyond 40 is multiplied by 1.5 and paid at your hourly rate.
Because New York's exemption salary thresholds can be higher than the federal ones, some salaried workers who are exempt under federal law are still owed overtime in New York. If you are salaried, check your status before relying on any calculation.
Gross pay = (regular hours × rate) + (overtime hours × rate × 1.5)
Example: 45 hours at $22 an hour
You worked 45 hours in the workweek.
- Regular pay: 40 hours × $22.00 = $880.00
- Overtime pay: 5 hours × $33.00 = $165.00
- Gross pay: $1,045.00
Who is not eligible for overtime?
New York sets its own minimum weekly salaries for the executive and administrative exemptions, and the amounts differ between New York City, Long Island and Westchester, and the rest of the state. They are adjusted over time, so confirm the current figure with the New York State Department of Labor.
Some industries, such as hospitality and building services, work under their own wage orders with additional requirements. This calculator does not model those orders.

Does weekend or holiday work count as overtime in New York?
Not by itself. It only counts as overtime if it takes your workweek total above 40 hours, unless your employer or contract provides a higher rate.
